Statement From Hangzhou Sanhe Food Co., Ltd.
To our respective customers:
 With regard to the patent infringement of Acesulfame K(AceK), Hangzhou Sanhe Food Co. Ltd has obtained favorable determination against Nutrinova, which has already been confirmed by United States International Trade Commission.  We also have won the following appeal at United States Court of Appeals for the Federal Circuit.  Recently there is a rumor about our Acek quality to create fear, uncertainty and doubt in our customers and the market.  The purpose of unfair competition is obvious.  Hangzhou Sanhe Food Co. Ltd is hereby making the following solemn statement:

1.Our company¡¯s AceK product is manufactured strictly in accordance with the national standard issued by the Light Industry of the People¡¯s Republic of China.  Our company is an ISO9002 company and its AceK products have past the ISO9002 quality control.  The quality of our product has achieved and satisfied the United States FCCIV standard and the European standard.  It has been greatly trusted by our customers in the past years.

  2.Our AceK product does not have any problem about its purity.  Our manufacturing process does not involve use of selenium.  We monitor and control the parameters of the fluoride during production.  The fluoride parameter specified by the FCC standard of the United States if less than 10mg/kg.  The European standard of such is less than 3mg/kg.  Our standard adopts the less than 3mg/kg and the actual test of our finished product reads even less than 1mg/kg.  Our company¡¯s Acek manufacturing process does not produce the side-product AK-5-CHLORO that only be produced by other manufacture process technologies.  The court of the International Trade Commission has confirmed that the AceK manufacture process of Sanhe is different from the other company.  The quality of our product is well recognized by many of our customers.  Therefore, our company firmly states that our AceK product used in food is absolutely safe.

3.Some competitors with ulterior motives adopt contemptible means to malign our company¡¯s product and to distort our reputation.  Hereby, this Hangzhou Sanhe Food Co.Ltd seriously issues a warning and will take a legal action if necessary. Furthermore, we will reserve the right to seek financial compensation in this regard.
